Edo Guber: A’Court Fines Shaibu, Re-Affirms Ighodalo Candidature

The Court of Appeal sitting in Abuja presided over by Justice A. M. Lamido, has reaffirmed the nomination of Asue Ighodalo as the governorship candidate of the Peoples Democratic Party, PDP, in Edo State.

The appallate unanimously held that Shaibu lacked the legal right to seek nullification of the primary election.

While dismissing the appeal marked CA/ABJ/CV/642/2024, Justice Lamido affirmed the May 27 judgment of the Federal High Court in Abuja, which refused to invalidate the governorship primary election conducted by the PDP in Edo State.

The court therefore awarded a cost of N1 million against Shaibu and in favour of the respondents.

Recalled that the Federal High Court in its judgement led by Justice James Omotosho held that Shaibu did not participate in the primary election and therefore lacked the locus standi to challenge its outcome.

The court noted that Shaibu participated in a parallel primary election conducted in his residence by a faction of the party and failed to explore and exhaust the internal dispute resolution mechanism of the PDP before approaching the court.

Justice Lamido further held that Shaibu’s team had no basis to call for the cancellation of the primary election results and nullification of Ighodalo’s candidacy.

He therefore dismissed the suit for want of merit
