ADA Loses Court Case Against INEC As Judge Rules Suit Incompetent

A Federal High Court in Abuja has dismissed a suit filed by the All Democratic Alliance against the Independent National Electoral Commission, ruling that the case lacked merit.

Justice Emeka Nwite held that the suit was incompetent because it was filed through an originating summons despite containing allegations of fraud.

According to the court, cases involving fraud must be initiated through a writ of summons, which allows full trial procedures, including witness testimony and cross-examination.

The judge said the filing method denied the defendants fair hearing and stripped the court of jurisdiction to hear the matter.

He subsequently upheld the defendants’ preliminary objection and dismissed the suit in its entirety.
