Following the alleged vandalism of his property by some thugs, Dr. Albert Ndulue, a 74-year-old retired gynecologist, has claimed N1 billion in compensation from NICON Trustees limited and its receiver/manager, Mr. Abah Onah.
Ndulue bemoaned that the suspects’ relentless attack on his home at plot 8, Block 24, Alma Estate, Lekki, Eti-Osa, Lagos, had caused him to endure mental agony, trauma, and injustice for the last five years.
The elderly man claimed that in 1991, when the area was still being filled in with sand, he paid Alma Beach for the land. However, Alma Beach did ultimately give him a 1,358.974 square meter block of property in 1993.
He said: “Following this allocation, I went to Alma Beach to request for the documents required by Lagos State government to regularise the purchase of the land, obtain governor’s consent and perfect my title. I was informed that Dr Wale Babalakin (SAN) had taken over Alma beach estate and was responsible for providing the requested documents.

“I approached Babalakin but he refused to give me the documents. Following his refusal, I sued Alma beach estate at the Lagos high court.
“After the court ruled in my favour, the firm gave me all the required documents, which I used to obtain governor’s consent, and submitted a building plan to the Lagos Physical Planning and Urban Development Authority.”
According to him, the Authority approved his plan in 2014 and he commenced construction with a fence round the land. Ndulue explained that while building, he discovered a notice on his property, which was an interim order of receivership in suit No FHC/L/CS/1242//2017 before a Federal High Court, Lagos. He said the court eventually found the suit to be fraudulent and incompetent and dismissed it on June 18, 2018.
Consequently, he continued the development of his property to almost completion, but in 2021 while away on medical vacation, he got a call from a neighbour that his property had been vandalised by some thugs and put up for sale.

“It was discovered that it was the same characters, who were parties to the interim suit already dismissed by the court, that were responsible for the attempted sale of his property,” he said.
The retired gynecologist lamented that it has since been a tug of war, as hoodlums recently invaded his property, looted and destroyed the building, including the roofs, doors, windows, among others.
According to him, these elements are still relying on the interim order, which had already been struck out for being fraudulent. He alleged that the other party had proceeded to Zone 2 police station and misrepresented facts to the Assistant Inspector General (AIG) in charge of the formation, that they had a final judgment to take over the property. Ndulue said all efforts to invite the police over the issue to hear his part of the story have remained unyielding.
